Terms of Service

Nextyme Terms of Service - the rules governing your use of the Nextyme appointment scheduling platform.

Please read these Terms of Service (Terms) carefully before using the Nextyme application (the Service) operated by CooperWurks (we, us, or our).

By creating an account or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Service.

1. Description of Service

Nextyme is an appointment-scheduling platform that allows individuals and businesses (Users) to create appointments, manage client records, and send notifications.

2. Accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You must provide accurate and complete information when registering.
  • If you leave optional profile fields (such as display name) blank, the Service may use your account email as an identifier in appointment communications sent on your behalf.
  • We may restrict, suspend, or close multiple free accounts created by the same person or entity.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Store or transmit unlawful, harmful, defamatory, or fraudulent content.
  • Send unsolicited communications (spam) to clients via the notification features.
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble the Service.
  • Resell or sublicense access to the Service without our prior written consent.

4. Client Data Responsibility

You acknowledge that you are the data controller for your clients' personal data. You are responsible for:

  • Obtaining any necessary consents to store and communicate with your clients.
  • Ensuring you have a lawful basis to send WhatsApp, Telegram, or email notifications.
  • Complying with applicable data protection laws (including GDPR where applicable) regarding your clients' data.
  • Responding to your clients' data subject access requests relating to appointment data.

If you send WhatsApp messages to United States phone numbers, you represent and warrant that you have obtained any required express written consent before doing so.

Nextyme includes opt-out support (including STOP handling) and consent acknowledgment controls, but you remain responsible for ensuring your use of WhatsApp messaging complies with the Telephone Consumer Protection Act (TCPA) and other applicable messaging laws.

If you send commercial electronic messages to Canadian recipients, you are responsible for obtaining and retaining valid consent records as required by CASL.

Nextyme supports this by requiring recipient-level email consent before non-transactional appointment emails, and supporting unsubscribe mechanisms (recipient consent revocation in client records and STOP for WhatsApp).

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Nextyme and its licensors. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of all content and data you upload to the Service (your appointments, client records, etc.).

6. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted, error-free operation. The Service is provided as is and as available without warranty of any kind, whether express or implied.

7. Limitation of Liability

To the maximum extent permitted by law, Nextyme shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill arising from: (a) your use or inability to use the Service; (b) any unauthorized access to your account; or (c) any third-party conduct in connection with the Service.

8. Termination

  • You may delete your account at any time via Settings -> Privacy -> Delete Account.
  • We may suspend or terminate your access if you violate these Terms, with or without notice.
  • Upon termination, your right to use the Service will immediately cease. We will delete your data in accordance with our Privacy Policy.

9. Governing Law

These Terms shall be governed and construed in accordance with applicable laws of the European Union / European Economic Area, without regard to conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via in-app notification or email. Continued use after the effective date constitutes acceptance of the revised Terms.
